Overview

FSSAI Registration in India

Any food business in India must have an FSSAI licence or food licence. A foodservice licence must be renewed when its validity period of one to five years has passed, otherwise it will be subject to a fine. 120 days before the FSSAI registration or licence expires, the renewal process can be finished.

The Department of Health and Family Welfare of the Government of India established the Food Safety and Standards Authority of India (FSSAI), an independent body. The Food Safety and Standards Act, 2006—a consolidation of Indian law and food safety—led to the establishment of the FSSAI. The FSSAI is in charge of regulating and overseeing food safety in order to safeguard and advance public health.

The Non-Executive Chairperson of the FSSAI is chosen by the Central Government or someone who currently holds a non-Secretariat position in the Government of India. FSSAI's Chief Executive Officer is Shri Arun Singhal, while the organization's current Chairperson is Rita Teaotia.

Frequently Asked Questions

FAQ

FSSAI Registration is a mandatory requirement for all food business operators in India. It is issued by the Food Safety and Standards Authority of India under the Food Safety and Standards Act, 2006. The registration ensures that food businesses comply with food safety standards and regulations to protect public health.

All food business operators including manufacturers, importers, distributors, exporters, retailers, food service providers, restaurants, cafes, and any business handling, processing, or selling food products need FSSAI Registration to operate legally in India.

There are three types of FSSAI Registration: Basic Registration (for businesses with turnover up to ₹12 lakhs), State License (for businesses with turnover between ₹12 lakhs and ₹20 crores), and Central License (for businesses with turnover above ₹20 crores, importers, exporters, and 100% export-oriented units).

Documents required include business registration certificate, PAN Card, GST registration (if applicable), identity proof of proprietor/partner/director, address proof of business premises, food safety management system plan, list of food products, layout/floor plan, and other documents as specified by FSSAI.

The FSSAI Registration process typically takes 7-15 working days, depending on the completeness of the application and the processing time of the FSSAI authority.

FSSAI returns are mandatory annual or periodic reports that food business operators must file with the FSSAI. These include annual returns (Form D1) for all food businesses and half-yearly returns (Form D2) for milk and milk product manufacturers. The returns must be filed by May 31st each year.

You can renew your FSSAI Registration by submitting a renewal application 120 days before the expiry date. You need to submit updated documents, pay the renewal fees, and ensure compliance with FSSAI regulations. Late renewal may attract penalties.

According to Section 2.1.13 (3) of the FSS (Licensing and Registration) Regulations, 2011, every food business operator who does not submit an annual FSSAI return within the allotted time will be fined Rs. 100 per day till the delay is resolved.

FSSAI Registration is typically valid for a period of 1 to 5 years as selected by the food business operator. It must be renewed before the expiry date to continue operating legally.
